Terms of Use

These Terms of Use ("Terms") govern your access to and use of Fitld websites, applications, APIs, and related services ("Services"). By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Who we are

"Fitld," "we," "us," and "our" refer to the operator of the Services. Contact details appear on our website and in our Privacy Policy.

2. Eligibility

You must be at least the age of digital consent in your jurisdiction (typically 16 or 18) to use the Services. If you use the Services on behalf of a business, you represent that you have authority to bind that business to these Terms.

3. Accounts and security

You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms or pose a security risk.

4. Acceptable use

You agree not to:

  • Violate applicable law or third-party rights.
  • Attempt to gain unauthorized access to systems, data, or other users' accounts.
  • Reverse engineer, scrape, or overload the Services except as expressly permitted in writing.
  • Upload malware, spam, or unlawful, defamatory, or infringing content.
  • Use the Services to build a competing product using our proprietary materials without permission.

5. Brand partners and API use

If you register as a brand partner, you are responsible for the accuracy of product and sizing data you provide, for compliance with consumer protection and advertising laws, and for how you integrate our APIs or widgets into your own sites and apps. API keys and tokens are confidential. You may not share them with unauthorized parties. We may rate-limit or suspend API access to protect the platform.

6. Shoppers and sizing recommendations

Size recommendations are generated from information you and brand partners provide. They are informational only and do not constitute professional fitting advice. Fit and comfort depend on many factors; we do not guarantee that a recommended size will be suitable for every individual or garment.

7. Intellectual property

The Services, including software, branding, documentation, and design, are owned by Fitld or its licensors. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the Services for their intended purpose. You retain ownership of content you upload; you grant us a license to host, process, and display that content as needed to operate the Services.

8. Third-party services

The Services may link to or interoperate with third-party sites or tools. Those are governed by their own terms; we are not responsible for third-party content or practices.

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FITLD AND ITS AFFILIATES, OFFICERS, AND EMPLOYEES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100), EXCEPT WHERE PROHIBITED BY LAW.

11. Indemnity

You will defend and indemnify Fitld against claims, damages, and expenses (including reasonable attorneys' fees) arising from your misuse of the Services, your content, or your violation of these Terms or applicable law.

12. Changes

We may modify the Services or these Terms. We will post updated Terms with a new "Last updated" date. Material changes may be communicated by email or in-product notice where appropriate. Continued use after changes become effective constitutes acceptance.

13. Termination

You may stop using the Services at any time. We may suspend or terminate access for breach of these Terms or for operational or legal reasons, with notice where practicable. Provisions that by their nature should survive (including disclaimers, limitations, and indemnity) will survive termination.

14. Governing law and disputes

These Terms are governed by the laws of the jurisdiction we designate for your region (to be finalized with legal counsel), excluding conflict-of-law rules. Courts in that jurisdiction will have exclusive venue, unless mandatory consumer protections in your country require otherwise.

15. General

These Terms constitute the entire agreement between you and Fitld regarding the Services. If any provision is unenforceable, the remainder stays in effect. Failure to enforce a provision is not a waiver.

16. Fees, trials, and taxes

Some Fitld features may be free during preview periods; others may require a paid plan. If we introduce or change fees, we will describe them at checkout or in an order form. You are responsible for applicable taxes unless otherwise stated in writing.

17. Beta and experimental features

We may label certain capabilities as beta or experimental. They may be less reliable or change without notice. You use them at your own risk; Sections 9 and 10 apply to the maximum extent permitted by law.

18. Feedback

If you send us ideas, suggestions, or feedback about the Services, you grant Fitld a perpetual, worldwide, royalty-free license to use them to improve the Services without obligation to compensate you, except where prohibited by law.

19. Data accuracy and merchant responsibility

Brands are responsible for the accuracy of product, pricing, and sizing data they publish through Fitld. Shoppers are responsible for the accuracy of self-reported measurements. Fitld does not independently verify every measurement or garment specification.

20. Export and sanctions

You may not use or export the Services in violation of export control or sanctions laws. You represent that you are not barred from receiving services under applicable law.

21. Electronic communications

You consent to receive notices electronically (including email and in-product messages). You are responsible for keeping your email address current.
